Presentation #1: Thursday, January 20, 1:00 – 2:30 pm
NY Community Medicaid – a 2022 Update
New York State has enacted a number of new laws and regulations regarding Community Medicaid services, although the pandemic has delayed the implementation of most of them. Most important is the introduction of a “look back” period for Medicaid services in the community.
The look back is 30 months (2 ½ years) for transfers of assets made before someone applies for Community Medicaid. Transferring assets would result in a “penalty period” during which the applicant would not be eligible for Medicaid to pay for their health care.
The new rules also change the process of becoming eligible for Medicaid, tighten the rules regarding who is eligible, institute new rules regarding whether or not to keep someone in their home, and more.
Mr. Cutner will discuss the new, more restrictive regulations, and review the current status of their implementation.
Presentation #2: Tuesday, February 8, 1:00 – 2:30 pm
Dealing with the risks of Long-Term Care: Long-Term Care Insurance, Medicaid Planning, or both?
Seniors who fail to make a plan to pay for long-term care – whether home care, assisted living, or nursing home – are in danger of depleting their entire life’s savings, and leaving their spouses and children exposed and vulnerable.
Fortunately, these risks can be avoided or mitigated. The best solution in a given case may be long-term care insurance, or Medicaid planning, or both. This presentation will focus on these options, enabling you to make an informed decision about what might be best for you or your loved ones.
Norman Portnow is the founder and CEO of Creative Wealth Planning, LLC, an independent insurance agency. He is a seasoned and experienced insurance agent and will discuss long-term care insurance. You will learn about policy terms such as the elimination period, inflation rider, going on the claim, and more.
David Cutner, the founding partner of Elder Law & Estate Planning firm Lamson & Cutner, has many years of experience assisting seniors to protect themselves from the devastating costs of long-term care. He will discuss Medicaid Planning and how it can protect you.

Lamson & Cutner strongly believes that too many elderly and disabled people forego benefits and opportunities that would dramatically improve their health care and their quality of life. Many deplete their life’s savings by private paying for long-term care, when assistance could easily be obtained at little or no cost.
All too often, the reason is lack of knowledge, and not knowing where to turn to find out.
The Elder Law attorneys at Lamson & Cutner devote a good deal of their time to providing free seminars and public presentations to address these issues, and to answer questions that people want to ask. Typically, these presentations involve topics such as eligibility requirements and strategies for obtaining Medicaid home care or Medicaid nursing home care, trusts to hold real estate or financial assets, pooled income trusts, supplemental needs trusts for the disabled, the durable power of attorney, the health care proxy and the living will, and estate planning.
Lamson & Cutner attorneys are much sought-after by senior centers, charitable and religious organizations, and nursing homes and hospitals, to speak to their members or their staff. Those who have some familiarity with Elder Law topics, or have listened to other speakers, frequently say that they have never heard anyone explain this subject matter in such a clear and understandable way.
This is what one satisfied presentation attendee said.
Just a quick thank you once more for taking the time to speak to the social work dept’ today. I’d like you to know that throughout the rest of the day, virtually every single one of my colleagues – as well as my supervisor and assistant director – stopped me to say how informative your presentation was, and to comment on the ease in which you imparted your knowledge and competence in an area that often comes up in our line of work.” – K.S., LMSW, Roosevelt Hospital – Department of Social Work
