Course 1:

Community Medicaid 2024, Including Home Care, ALPs, and Pooled Income Trusts

Tuesday, May 7, 5:00 - 7:00 PM

Many Social Work clients will need expensive long-term care services in the home. Guiding clients on how to protect themselves and seek help has never been more important.

Numerous changes to the rules and procedures for Community Medicaid have been made in the past few years.  Learn how these changes have impacted eligibility, protection of assets and income, and obtaining the proper level of care once eligibility has been established.

This course will explain the strategies Medicaid applicants can use to protect their life’s savings, so they can remain in their homes as long as possible without becoming impoverished.  Also, learn how to start the process of finding home health care through an agency or CDPAP, or how to find the assisted living residence that best suits a client’s needs.

This program will inform you about your clients’ possible legal options in connection with Medicaid benefits and other legal matters. With this knowledge, you will be better able to provide guidance about when it is important and appropriate for them to consult with an Elder Law attorney. It is important for non-lawyers to avoid providing advice about legal matters, and you don’t want to let the desire to be helpful overcome the caution you should bring to any discussion about legal rights and options.

This course will provide 2.0 CEU credits to NYS Licensed Social Workers and Case Managers with the CCM designation.

Course 2:

Estate Planning and Advance Directives, including the Power of Attorney (POA) and Health Care Proxy (HCP)

Wednesday, June 5, 5:00 - 7:00 PM

Estate planning is important for everyone, including social workers’ and case managers’ clients.  Most people are unaware of all the issues that should be considered, or of the different options that may be available to them.

For those who already have estate planning documents, there are important reasons why these documents should be reviewed and updated from time to time.  In many cases, their life circumstances, or those of their children or other beneficiaries, may have changed over time.   In some cases, your clients may need to take steps to avoid or limit estate taxes.  Crucially, all except extremely wealthy people are vulnerable to financial ruin if they do not have a long-term care plan.  Learn how, in most cases, a long-term care plan can be seamlessly integrated with an effective estate plan.  The course will also discuss why a robust Power of Attorney and a Health Care Proxy are essential documents for every adult.

This program will inform you about your clients’ possible legal options in connection with Estate Planning and other legal matters.

This course will provide 2.0 CEU credits to NYS Licensed Social Workers. Authorization to grant CE credits to Case Mangers with the CCM designation is in process.

October 25, 2023 - "Integrating Your Estate Plan with a Long-Term Care Plan"

A video of this presentation is available below

Speaker: Julia Santo, Esq.
Presented by the Westchester County Senior Law Day Collaborative

An estate plan expresses and implements your wishes regarding the distribution of your assets upon your death.  Unfortunately, ruinous long-term care costs can drain your life savings, leaving little or nothing in your estate to distribute.

Learn how integrating a long-term care plan with your estate plan can protect your assets and lifestyle while you are alive, and maximizes the chance that you will have an estate to leave to your family members or other beneficiaries.

July 18, 2023 FREE Virtual CEU Course - 2.0 Credit Hours

"Nursing Home Medicaid Update 2023" Sponsored by The Bristal and 305 West End Assisted Living

Tuesday, July 18, 2:00 – 4:00 pm via Zoom

This program will explain how Nursing Home Medicaid differs from Community Medicaid, the rules for Medicaid Nursing Home eligibility, and issues related to the resident’s income and spousal income. We will also cover aides in the Nursing Home and the Nursing Home Transition and Diversion (NHTD) program.

Most importantly, we will discuss how your clients can protect a good portion of their assets, even if no planning was done before nursing home care was needed.

Why Lamson & Cutner believes that educating yourself about long-term care is crucial to your wellbeing
seminars

Lamson & Cutner strongly believes that too many elderly and disabled people forego benefits and opportunities that would dramatically improve their health care and their quality of life. Many deplete their life’s savings by private paying for long-term care, when assistance could easily be obtained at little or no cost.

All too often, the reason is lack of knowledge, and not knowing where to turn to find out.

The Elder Law attorneys at Lamson & Cutner devote a good deal of their time to providing free seminars and public presentations to address these issues, and to answer questions that people want to ask. Typically, these presentations involve topics such as eligibility requirements and strategies for obtaining Medicaid home care or Medicaid nursing home care, trusts to hold real estate or financial assets, pooled income trusts, supplemental needs trusts for the disabled, the durable power of attorney, the health care proxy and the living will, and estate planning.

Lamson & Cutner attorneys are much sought-after by senior centers, charitable and religious organizations, and nursing homes and hospitals, to speak to their members or their staff. Those who have some familiarity with Elder Law topics, or have listened to other speakers, frequently say that they have never heard anyone explain this subject matter in such a clear and understandable way.

This is what one satisfied presentation attendee said:

Just a quick thank you once more for taking the time to speak to the social work dept’ today. I’d like you to know that throughout the rest of the day, virtually every single one of my colleagues – as well as my supervisor and assistant director – stopped me to say how informative your presentation was, and to comment on the ease in which you imparted your knowledge and competence in an area that often comes up in our line of work.” – K.S., LMSW, Roosevelt Hospital – Department of Social Work
